Is Street Racing Illegal In NSW?

In all seriousness, within NSW, it is an offence to participate in street racing or ‘hoon’ behaviour, such as, burnouts, doughnuts and drag racing. The act of street racing or hoon behaviour are highly dangerous for those involved as well as bystanders and other motor vehicle drivers. For this reason, it is a serious traffic offence as it can lead to severe injury or even death. Police have certain powers to impose roadside sanctions on people who are caught racing or ‘hooning’, including confiscating your vehicle.  

If you are found guilty of speed racing or hoon offences, you can be fined up to $3,300 if it is your first offence. If you have committed the offence, the maximum penalty is a fine of $3,300 or imprisonment for 9 months. Your driving licence may be disqualified for a certain period as determined by the court.

The Prosecution must prove beyond reasonable doubt that you organised, promoted, or participated in a street racec, speed trial or attempt to bread a speed record on a road in NSW. In relation to hoon behaviour, the Police must establish that you deliberatley caused the vehicle to lose traction when proving the offence against you.
